Welcome to the website (the "Site") of MaiaLearning, Inc. ("MaiaLearning", "we", "us", and "our"). This Website Privacy Policy explains what personal information we collect through the publicly available pages of the Site, our tools for University and Community-based organization staff users and our other marketing activities, how we use and share that information, and your choices concerning our information practices. 

Before using the Site or submitting any personal information to MaiaLearning, please review this Website Privacy Policy carefully and contact us at support@maialearning.com if you have any questions. 

This Website Privacy Policy does not apply to our processing of student, teacher, counselor or guardian information. To learn more about how we process that information, please review our Educational User Privacy Policy.

1. Personal Information collection

Personal Information you provide:

  • Identification Information: we may collect your name, email address, and phone number through the Site or through our social media platforms.
  • Communication Information: we may collect any information included in your communications with us.

Internet Activity Information: When you visit the Site, we may automatically log the following information:

  • Device Information: the manufacturer and model, operating system, IP address, and unique identifiers of the device, as well as the browser you use to access the Site. The information we collect may vary based on your device type and settings. 
  • Usage Information: information about how you use our Site, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency, and duration of your activities. We may use Google Analytics, a web analytics service provided by Google LLC (“Google”) to help collect and analyze Usage Information. The following technologies may be used to collect Internet Activity Information:

  • Cookies, which are text files stored on your device to uniquely identify your browser or to store information or settings in the browser to help you navigate between pages efficiently, remember your preferences, enable functionality, help us understand user activity and patterns, and facilitate online advertising. 
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

2. Personal Information use

We use your Personal Information for:

Site Delivery, including to provide, operate, maintain, and secure the Site.

Communicating with You, including to:

  • send you updates about administrative matters such as changes to our terms or policies; and
  • provide user support, and respond to your requests, questions and feedback.

Site Improvement, including to:

  • improve the Site and create new features;
  • personalize your experience; and
  • create and derive insights from de-identified and aggregated information.

Marketing and Advertising: we and our advertising partners may use your personal information for marketing and advertising purposes, including:

  • Direct Marketing: to send you direct marketing communications as permitted by law, including, but not limited to, notifying you of special promotions, offers and events via email and other means.

Compliance and Protection, including to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit our compliance with legal and contractual requirements and internal policies; and
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

3. Personal Information sharing

In certain circumstances we may share your personal information with:

  • Service Providers: including hosting services, cloud services, and other information technology services, email communication software and email newsletter services, advertising and marketing services, customer relationship management and customer support services, and analytics services. Pursuant to our instructions, these parties will access, process, or store personal information in the course of performing their duties to us.
  • Professional Advisors: such as lawyers, accountants and auditors where doing so is necessary to facilitate the services they provide to us. 
  • Business Transaction Recipients: such as counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction, and with a successor or affiliate as part of or following that transaction.
  • Government Authorities: we do not volunteer your personal information to government authorities or regulators, but we may disclose your personal information where required to do so for the Compliance and Protection purposes described above.

4. Educational Users

Please review our Educational User Privacy Policy to learn how we additionally process student's, guardian's and school staff's information provided to us by schools. While using the Site Educational Users are bound by this Website Privacy Policy.

5. University and Community-based organization Users

When you register an account with MaiaLearning as a user at a University or Community-based organization, we collect the information you provide with your registration. This includes name, contact information, email address, phone number and organization details.

We use and disclose this information to facilitate connections on the Site with Educational Users at schools. We may use and disclose this information a) to improve the administration of the Site, b) as otherwise necessary to comply with relevant laws, c) to respond to subpoenas or warrants served on MaiaLearning, and d) to protect and defend rights or property of MaiaLearning or others.

6. Third Parties

The Site may contain links to other websites not operated or controlled by MaiaLearning, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Website Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

You can log into MaiaLearning using Google credentials by clicking on the Google Sign-In button on the MaiaLearning login page. MaiaLearning's use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

7. Security

We use reasonable technical, organizational and physical safeguards designed to protect the personal information we collect. However, we cannot guarantee the security of your personal information and you use the Site at your own risk.

8. Your choices

Update or Correct Personal Information: You can contact us and request any updates or corrections needed to keep your personal information accurate, current, and complete. 

Opt Out of Marketing Communications: You may opt out of marketing-related communications by following the opt out or unsubscribe instructions contained in any marketing communication we send you. Please note, however, that you may continue to receive communications as described in the Communicating with You section after opting out of marketing communications.

Data retention and Deletion: Your data will be retained for the length of time needed to fulfill the purposes outlined in this privacy policy, and to provide the services contracted by our customers, unless a longer retention period is required by contract or by law. When the data retention period expires for a given type of data, we will delete it, or de-identify it such that it can no longer be used to identify you. You may request deletion of your personal information, subject to contract or law, by email at support@maialearning.com.

9. Privacy Frameworks

MaiaLearning complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. MaiaLearning  has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  MaiaLearning has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this Website Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

MaiaLearning is the Controller of personal information it receives under the Data Privacy Framework pursuant to this Website Privacy Policy and subsequently transfers to a third party acting as an agent on its behalf.

MaiaLearning complies with the Data Privacy Framework Principles for all onward transfers of personal datafrom the EU, UK or Switzerland, including the onward transfer liability provisions. MaiaLearning’s contracts with third-party agents that receive personal data under the Data Privacy Framework require such agents to provide the same level of protection as is required by the DPF Principles. MaiaLearning shall remain liable under the DPF Principles if its agent processes personal data in a manner inconsistent with the DPF Principles, unless MaiaLearning proves that it is not responsible for the event giving rise to the damage.

MaiaLearning, Inc. is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Individuals in the EU, UK, and Switzerland whose personal data has been transferred to MaiaLearning under the Data Privacy Framework have the right to request access to their personal data. You may also request that we correct, amend, or delete your personal data where it is inaccurate or has been processed in violation ofthe DPF Principles. To exercise these rights, please contact us at legal@maialearning.com. We will respond to your request within a reasonable timeframe. We may limit or deny access where the burden or expense of providing access would be disproportionate to the risks to your privacy, or where the rights of persons other than the requesting individual would be violated.

MaiaLearning will offer EU, UK, and Swiss individuals the opportunity to choose (opt out) whether their personal data is (a) to be disclosed to a non-agent third party, or (b) to be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by the individual. For sensitive personal information, MaiaLearning will obtain affirmative express consent (opt in) from the individual if such information is to be (a) disclosed to a non-agent third party, or (b) used for a purpose other than those for which it was originally collected or subsequently authorized by the individual through the exercise of opt-in choice. In compliance with the Principles, MaiaLearning commits to resolve complaints about our collection or use of your personal information. EU, UK or Swiss individuals with inquiries or complaints regarding our Data Privacy Framework policy should first contact MaiaLearning at: legal@maialearning.com. We will investigate and attempt to resolve any complaints or disputes regarding the use or disclosure of your EU Personal Data, UK Personal Data or Swiss Personal Data within 45 days of receiving your complaint.

MaiaLearning's independent recourse mechanism for Data Privacy Framework complaints for use by EU, Swiss and UK individuals is JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.
